La Ley de Justicia y Paz, análisis constitucional, competencia de la jurisdicción internacional y efectos en el desarrollo humano

RESUMEN
La justicia y la paz, son elementos indispensables para el Desarrollo Humano Sustentable y en sí mismos son valores que se informan mutuamente, se condicionan y se retroalimentan. Sin embargo, la búsqueda de la paz puede implicar, en casos de conflicto como el que vive Colombia, el sacrificio de una parte de la justicia así como algunas restricciones a otros derechos humanos.
El presente estudio versa principalmente sobre la ley de Justicia y Paz (ley 975) para lo cual empieza por analizar su validez constitucional y la forma en que fue reglamentada, luego de ello entramos a revisar hasta que punto la restricción de los derechos particulares relacionados con la justicia se legitima con la búsqueda de una paz sustentable y en especial, cuál es el límite de la jurisdicción internacional en la materia, a fin de determinar si el proceso de Justicia transicional que se desarrolla en Colombia es compatible con el Desarrollo Humano Sustentable y si sus consecuencias se justifican frente a dicho objetivo.

ABSTRACT
Justice and peace are vital elements for the Human Development Sustainable and in themselves they are principles that are mutually conditioned, and they are mutually reloaded. Nevertheless, the search of the peace can imply, in cases of conflict like which Colombia lives, the sacrifice of a part of justice and restrictions for the human rights.
Study of law “Justicia y Paz” (law 975) begins to analyze his validity constitutional and form in which it was regulated, soon has to review to what extent the restriction of the particular rights related to justice is compatible with the search of a sustainable peace and in special, which is the limit of the international jurisdiction in the matter, in order determining if the process of Justice and Peace that is developed in Colombia is compatible with the Human Development Sustainable and if their consequences are justified this objective as opposed to.
